Terms & Conditions
1. Scope
These Terms & Conditions apply to all orders placed by consumers through www.58grams.com, operated by 58 grams UG (haftungsbeschränkt), Am Weiher 11, 20255 Hamburg, Germany ("we", "us").
2. Contract Partner and Conclusion of Contract
The display of products in our store does not constitute a binding offer, but an invitation to order. By placing an order, you submit a binding offer to purchase. The contract is concluded when we send a separate order confirmation or ship the goods.
3. Prices and Payment
All prices include statutory VAT where applicable, plus shipping costs shown at checkout. Accepted payment methods are displayed at checkout.
4. Delivery
We ship to the countries listed at checkout. Estimated delivery times shown at checkout are non-binding unless expressly stated otherwise. Risk of loss passes to the consumer upon delivery.
5. Right of Withdrawal
Consumers have a statutory right of withdrawal as described in our separate Right of Withdrawal policy.
6. Retention of Title
The delivered goods remain our property until full payment has been received.
7. Warranty (Gewährleistung)
Statutory warranty rights apply under German law (§§ 434 ff. BGB). Please contact clubhouse@58grams.com to report a defect.
8. Limited Editions
Products are released in limited quantities as stated on the product page. We reserve the right to cancel an order and refund payment if a product is unexpectedly out of stock after purchase.
9. Liability
We are liable without limitation for damages resulting from injury to life, body or health, and for damages caused by intent or gross negligence. For ordinary negligence, we are liable only for breach of a material contractual obligation, limited to foreseeable, contract-typical damage.
10. Applicable Law and Jurisdiction
These Terms are governed by German law, excluding the CISG. This does not deprive consumers of protection granted by mandatory provisions of the law of their country of residence.
